ALL USED EQUIPMENT IS SOLD "AS IS-WITH ALL FAULTS". ALL SALES OF NEW OR USED EQUIPMENT ARE WITHOUT WARRANTY BY SELLER, EITHER EXPRESS OR IMPLIED. ALL WARRANTIES ARE DISCLAIMED BY SELLER, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

1.         All sales are final. Seller's liability for equipment damaged in shipping, non-working equipment or equipment which does not conform to this Sales Order is strictly limited to a refund of the sales price, less a 20% charge for restocking at Seller's option. Under no circumstances will Seller be liable to Buyer for consequential damages. All returns must be pre-approved by Seller.

2.         All sales and shipments to states other than Michigan are subject to all applicable sales, use and other taxes imposed by those states. Seller will not charge, collect or pay those taxes and all such taxes must be reported and paid by Buyer. Buyer will indemnify and hold Seller harmless for the payment of such taxes.

3.         Buyer must immediately inspect all shipments for damage and to insure that the equipment is in working order. All observable damage to the packaging and/or the equipment at the time of delivery must be reported on the waybill and immediately reported to Seller. Equipment should be unpacked and tested immediately. Seller shall have no responsibility for damaged or non-working equipment which is not reported to Seller within seven (7) days of delivery. Claims for damaged or non-working equipment not reported to Seller within seven (7) days of delivery will be deemed waived.

4.         New equipment may be covered by a manufacturer's warranty and all such warranty claims shall be handled directly between the manufacturer and Buyer. SELLER DISCLAIMS ALL WARRANTIES AS SET FORTH ABOVE.

No equipment will be shipped until Buyer has signed and returned this Sales Order, signifying Buyer's acceptance of the Terms of Sale. Failure to do so will result in the cancellation of the order.
